CA Supreme Court Rejects Petition to Keep Marriage Initiative Off of November Ballot
San Francisco, CA – California’s high court denied a petition to keep Proposition 8 off of the November ballot. Proposition 8 states: “Only a marriage between a man and a woman is valid or recognized in California.”
The petition was filed by the ACLU, Equality California, Lambda Legal and National Center for Lesbian Rights who argued that the ballot measure was a revision to California’s constitution and thus required a constitutional convention. An additional position was proffered that the measure did not accurately summarize the effects of the proposed amendment to the state’s constitution. A unanimous court denied the petition without comment.
